TruckerHand Terms and Conditions

Important: These Terms affect your legal rights. Read them before creating an account, starting a trial, purchasing a subscription, or using TruckerHand.

1. Agreement to these Terms

These Terms and Conditions (the “Terms”) are a legally binding agreement between you and TheMagne LLC, a Tennessee limited liability company (“TheMagne,” “we,” “us,” or “our”), governing your access to and use of TruckerHand, including its websites, progressive web application, software, dashboards, tools, content, and related services (collectively, the “Service”).

By creating an account, actively checking the acceptance box, starting a trial, purchasing a subscription, or using the Service, you confirm that you have read, understood, and agree to these Terms and the TruckerHand Privacy Policy. If you do not agree, do not access or use the Service.

2. Eligibility and authority

You must be at least 18 years old and legally capable of entering a binding contract. TruckerHand is not intended for children or minors. If you use the Service for a company, fleet, carrier, or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

The Service is designed primarily for users in the United States. You are responsible for determining whether your use is lawful where you operate.

3. What TruckerHand provides

TruckerHand is a mobile business companion that helps users organize trips, expenses, rate-per-mile calculations, accessorial pay, settlement records, compliance documents, maintenance information, tax-preparation exports, wellness entries, analytics, and AI-assisted workflows.

TruckerHand is not a load board, freight broker, dispatcher, transportation management system, electronic logging device, navigation system, accounting firm, tax preparer, law firm, medical provider, financial adviser, insurance provider, or government compliance service. Any demo load information is clearly labeled as demo data and must not be used for real load decisions.

4. Accounts and security

You must provide accurate, complete, and current account information. You are responsible for protecting your credentials and for all activity under your account. Notify us promptly at contact@magnellc.com if you suspect unauthorized access.

You may not create duplicate or deceptive accounts to bypass trials, usage limits, suspensions, pricing, or other controls. We may require reasonable verification and may suspend access while investigating suspected misuse or security incidents.

5. Limited right to use the Service

Subject to these Terms and payment of applicable fees, TheMagne grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use TruckerHand for your lawful personal or internal business operations. No ownership interest in TruckerHand or its intellectual property is transferred to you.

6. Trial, subscriptions, billing, and renewal

Eligible new users may receive one 14-day trial without providing a credit card. The trial begins when it is activated through the Service and ends automatically after 14 days. Access is restricted when the trial ends unless you purchase a subscription. One trial is permitted per person or business; duplicate accounts used to obtain additional trials may be terminated.

Paid subscriptions, available features, prices, billing intervals, and any taxes are shown on the pricing and checkout screens before purchase. Stripe processes payments. We do not store your full payment-card number.

Subscriptions renew automatically for the same billing interval until canceled. By subscribing, you authorize recurring charges to your selected payment method. To avoid the next renewal charge, cancel before the renewal date. We may change fees or plans prospectively after providing notice at least one billing cycle before the change takes effect.

7. Cancellation and 30-day guarantee

You may cancel at any time through the available account or billing controls or by contacting contact@magnellc.com. Cancellation stops future renewals; unless otherwise stated at checkout, paid access continues through the end of the current billing period.

TheMagne offers a 30-day money-back guarantee on a user’s first paid TruckerHand purchase. To request it, contact us within 30 calendar days after the initial paid charge. The guarantee does not apply to renewal charges, prior refunded accounts, fraudulent activity, abuse, or accounts terminated for material violations, except where applicable law requires otherwise. Approved refunds are returned to the original payment method. No refund applies to the free trial because no trial fee is charged.

8. Your data and content

You retain ownership of the trip, expense, receipt, settlement, compliance, vehicle, wellness, and other information you submit (“User Data”). You grant TheMagne a limited, non-exclusive license to host, store, process, reproduce, transmit, back up, and display User Data only as reasonably necessary to operate, secure, support, and improve the Service or comply with law.

You represent that you have the legal right to submit User Data and that it does not violate another person’s privacy, confidentiality, intellectual-property, or other rights. Do not upload Social Security numbers, complete payment-card data, banking passwords, medical records, or other highly sensitive information that the Service does not request.

You are responsible for maintaining source records and exporting information you need. After an unpaid trial expires, trial data may be retained for up to 30 days and then scheduled for deletion, subject to backups, fraud prevention, legal holds, security needs, and legal retention obligations. Other account data is handled as described in the Privacy Policy.

9. AI-assisted features

AI-assisted features may generate drafts, categorizations, calculations, summaries, negotiation language, or other outputs. AI output can be incomplete, outdated, biased, or incorrect. You must independently review every output before relying on it or adding it to your records.

AI output is informational only and is not legal, tax, accounting, financial, medical, safety, dispatch, regulatory, or other professional advice. TheMagne does not guarantee any negotiation result, rate, profit, deduction, compliance outcome, health result, or business decision.

10. Trucking, safety, wellness, and compliance

Never interact with TruckerHand while driving or when doing so would be unsafe or unlawful. TruckerHand does not replace safe-driving judgment, official routing tools, carrier instructions, vehicle inspections, emergency services, medical care, or government records.

You remain solely responsible for compliance with traffic laws, hours-of-service rules, FMCSA and DOT requirements, licensing, permits, IFTA, IRP, insurance, tax obligations, vehicle condition, cargo, hazmat rules, carrier contracts, and all other requirements applicable to your operation.

Wellness tools are optional informational trackers, not medical devices or medical advice. For an emergency or concerning health measurement, stop using the Service and contact emergency services or a qualified healthcare professional.

11. Prohibited activities

You may not misuse the Service or help another person do so. Prohibited conduct includes:

  • Using the Service for unlawful, fraudulent, unsafe, abusive, or deceptive activity.
  • Uploading malware or content that infringes intellectual-property, privacy, confidentiality, or other rights.
  • Accessing another user’s account or data without authorization.
  • Bypassing authentication, subscriptions, rate limits, security controls, or feature restrictions.
  • Scraping, crawling, data-mining, reverse engineering, decompiling, disassembling, or attempting to derive source code except where applicable law expressly permits it.
  • Overloading, disrupting, probing, or testing the Service without written authorization.
  • Reselling, sublicensing, sharing, or commercially exploiting access except under a written agreement with TheMagne.
  • Submitting false reviews, false support reports, fraudulent refund requests, or misleading information.

12. TheMagne intellectual property and feedback

TruckerHand and its software, designs, databases, workflows, graphics, text, logos, trademarks, and other materials are owned by or licensed to TheMagne and are protected by applicable laws. Except for the limited use right in these Terms, no rights are granted to you.

If you voluntarily provide suggestions or feedback, you grant TheMagne a perpetual, worldwide, royalty-free right to use that feedback without restriction or compensation. This does not transfer ownership of your private User Data.

13. Third-party services

TruckerHand may rely on third parties such as Clerk for authentication, Supabase for data services, Stripe for payments, Vercel for hosting, AWS for email or infrastructure, mapping and weather sources, and AI service providers. Their separate terms and privacy practices may apply.

TheMagne does not control and is not responsible for third-party availability, acts, omissions, content, or policy changes. Third-party outages or changes may affect the Service.

14. Privacy and electronic communications

The TruckerHand Privacy Policy explains how personal information is collected, used, disclosed, secured, retained, and deleted. By using the Service, you acknowledge that policy.

You consent to receive contracts, notices, receipts, billing messages, security alerts, and other communications electronically. Electronic records and clickwrap acceptance satisfy any requirement that communications or agreements be in writing, to the extent permitted by law. Marketing messages, if any, remain subject to applicable consent and opt-out requirements.

15. Availability and changes to the Service

The Service may be modified, updated, interrupted, restricted, or discontinued. We do not promise uninterrupted access, error-free operation, or a specific service level. We may impose reasonable limits to protect security, reliability, users, and costs.

16. Suspension and termination

We may suspend or terminate access for nonpayment, security risk, unlawful activity, fraud, material breach, abuse, or conduct that threatens users, third parties, or the Service. When reasonably practical, we may provide notice and an opportunity to correct the issue, but immediate action may be necessary for security, safety, legal, or fraud concerns.

You may stop using TruckerHand and cancel your subscription at any time. Upon termination, your right to use the Service ends, but provisions that by their nature should survive,including ownership, disclaimers, liability limits, indemnity, disputes, and miscellaneous terms,remain effective.

17. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKERHAND IS PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.” THEMAGNE AND ITS LICENSORS AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE OR ANY OUTPUT WILL BE ACCURATE, CURRENT, SECURE, UNINTERRUPTED, ERROR-FREE, COMPATIBLE WITH YOUR SYSTEMS, OR SUITABLE FOR ANY PARTICULAR BUSINESS, SAFETY, TAX, LEGAL, MEDICAL, OR COMPLIANCE PURPOSE.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEMAGNE AND ITS MEMBERS, PERSONNEL, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA; BUSINESS INTERRUPTION; MISSED LOADS; ACCIDENTS; FINES; PENALTIES; TAX OR REGULATORY OUTCOMES; HEALTH OUTCOMES; OR THIRD-PARTY CONDUCT ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THEMAGNE FOR ALL CLAIMS ARISING FROM OR RELATED TO TRUCKERHAND WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO THEMAGNE FOR TRUCKERHAND DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law and do not limit rights that cannot legally be waived.

19. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless TheMagne and its members, personnel, affiliates, licensors, and service providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your User Data, unlawful or unsafe conduct, misuse of the Service, infringement of another person’s rights, or material breach of these Terms. We may control the defense of a covered claim, and you agree to reasonably cooperate.

20. Copyright and infringement notices

If you believe content available through TruckerHand infringes your copyright, send a written notice to contact@magnellc.com identifying the copyrighted work, the allegedly infringing material and its location, your contact information, a good-faith statement, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature. Knowingly false notices may create liability.

21. Informal disputes and governing law

Before filing a claim, you and TheMagne agree to attempt a good-faith informal resolution. The complaining party must send a written description of the dispute and requested resolution to contact@magnellc.com. The parties will have 30 days after receipt to try to resolve it.

These Terms are governed by Tennessee law, without regard to conflict-of-law rules, except where federal law or non-waivable law applies. These Terms do not require arbitration and do not waive any right to participate in a class action or jury trial. Any claim must be brought in a court that has lawful jurisdiction.

22. Changes to these Terms

We may update these Terms prospectively. We will post the revised effective date and provide notice when reasonably required. Material changes,including changes to billing, refunds, data use, dispute rights, liability, or other significant obligations,may require you to review and actively accept a new version before continuing to use protected features. Continued use after a non-material update takes effect constitutes acceptance where permitted by law.

23. California consumer notice

California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

24. Miscellaneous

These Terms and the Privacy Policy are the entire agreement concerning the Service and replace prior understandings on that subject. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; TheMagne may assign them in connection with a merger, financing, reorganization, or sale of business or assets.

TheMagne is not liable for delay or failure caused by events beyond its reasonable control. These Terms do not create a partnership, joint venture, employment, agency, fiduciary, or franchise relationship. Headings are for convenience only. The English version controls if a translation conflicts with it.
